Conditions of sale

These General Conditions of Sale govern the offer and sale of products through the website  www.seitron.com  ("Site").

The products marketed on the Site ("Products") are offered and sold by Seitron S.p.A., with registered office in via del Commercio 9/11, 36065 Casoni di Mussolente (VI), C.F. / VAT number and Company Register 00775330244, Share Capital Euro 1,000,000.00 I.V. Seitron S.p.A. is the owner of the Site.

Scope of application

1.1 These General Conditions of Sale apply to all sales made by Seitron S.p.A. on the Site. The offer and sale of the Products on the Site constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce.

1.2 Any changes and/or new conditions will be in force from the moment of their publication on the Site, in the "Conditions of Sale" section.  Users are therefore invited to regularly access the Site and to consult, before making any purchase, the most updated version of the General Conditions of Sale. The storage and reproduction of all information that Seitron S.p.A. provides is permitted. provides on the Site, before and during the purchase procedure.

1.3 The applicable General Conditions of Sale are those in force on the date of sending the purchase order.

1.4 These General Conditions of Sale do not regulate the sale of products and/or the provision of services by parties other than Seitron S.p.A. that are present on the Site via links, banners or other hyperlinks. Before carrying out commercial transactions with these entities it is necessary to check their conditions of sale. Seitron S.p.A. is not responsible for the provision of services and/or the sale of products by such entities. Seitron S.p.A. does not carry out any control and/or monitoring on the websites accessible through such links, therefore it is not responsible for the contents of such sites nor for any errors and/or omissions and/or violations of the law by them.

1.5 These General Conditions of Sale are applicable in the following States: Italy.

Purchases on the site

2.1 The purchase of Products on the Site is permitted only to individuals (“User” or “Customer”) who: are at least 18 years of age; who have the status of consumers, meaning natural persons who, in relation to the purchase of the Products, act for purposes unrelated to any entrepreneurial, commercial, professional or artisanal activity carried out.

2.2 Seitron S.p.A. reserves the right to refuse or cancel orders that come from: a user with whom it has an ongoing legal dispute; a user who has previously violated the conditions and/or terms of the purchase contract with Seitron S.p.A.; a user who has been involved in fraud of any kind and, in particular, in fraud relating to credit card payments; users who have provided false, incomplete or otherwise inaccurate identification data.

2.3 The user is allowed to purchase multiple Products with the same order ("Multiple Order"). Seitron S.p.A. furthermore reserves the right not to accept a multiple Order if it concerns more than three pieces of the same item within the same. In the event of violation of these prohibitions or in the case of orders, from anyone originating, which are anomalous in relation to the quantity of products purchased or the frequency of purchases made, Seitron S.p.A. reserves the right to take all actions necessary to put an end to the irregularities, including the non-acceptance or cancellation of irregular orders or, following a joint resolution with Seitron S.p.A., the suspension of access to the Site or the cancellation of registration on the Site.

Registration on the Site

3.1 The purchase of Products on the Site can take place after registering on the Site or in guest mode.

3.2 Guest mode allows the customer to place orders on the site without creating an account on the site. In order to allow the correct processing of the order, information relating to shipping, payment methods and issuing the invoice will be requested, if requested by the customer. This mode does not allow access to the reserved area. However, the customer will receive the order confirmation via email and the notification to be able to monitor the shipment, by the carrier.

3.3 Registration on the Site is free. To register on the Site, the user must complete the appropriate form, entering name, surname, e-mail address and password. To confirm registration and account creation, you need to click on "Create An Account". Successful registration on the Site will be confirmed to the user via a specific e-mail.  In any case, the registration credentials must be kept with extreme care and attention, they can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them. He also undertakes to immediately inform Seitron S.p.A. in the event that you suspect or become aware of improper use or improper disclosure of the same.

3.4 Registration on the Site, by opening a personal account called "My Account", allows the user to: manage and update their personal data at any time; save and modify your contact and shipping addresses; access all the information relating to your orders and any returns; view your “Wish List”; revoke, at any time, any consent expressed.

3.5 The user guarantees that the personal information provided during the registration procedure on the Site and/or at any other time of his relationship with Seitron S.p.A. are complete and truthful and undertakes to keep Seitron S.p.A. unharmed and held harmless from any damage, compensation obligation and/or sanction deriving from and/or in any way connected to the violation by the user of the rules on registration on the Site or on the conservation of registration credentials.

3.6 Registration on the Site and/or purchase via the Site constitutes acceptance of these General Conditions of Sale.

Conclusion of the contract

4.1 In compliance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, Seitron S.p.A. informs the user that to conclude the purchase contract for one or more Products on the Site, the user must complete an order form in electronic format and send it to Seitron S.p.A., electronically, following the instructions that appear from time to time on the Site. The contract is concluded when the order form reaches the Seitron S.p.A. server. Before transmitting the order form, the user will be able to identify and correct any data entry errors by following the instructions on the Site.

4.2 Once the order form has been registered and confirmation of the validity of the payment method used has been received, Seitron S.p.A. will send the user, to the email address indicated, the order confirmation containing the following: a summary of the billing and shipping information and the payment method used. For each Product purchased, a summary of the essential characteristics, the price and the quantities ordered will be reported. The total amount of the Products ordered "Subtotal", the sum of the handling and shipping costs if any ("Shipping and Handling") and the total amount paid ("Overall Total") will be summarized. The order form will be archived in the Seitron S.p.A. database. for the time necessary for the execution of the same and, in any case, within the terms of the law. To access your order form, the registered user can consult the "My Account - My orders" section of the Site.

4.3 The languages ​​available to users for the conclusion of the contract are Italian and English. Customer Service is able to communicate with users in the following languages: Italian, English, Spanish and French.

Availability and Product Information

5.1 The Products offered on the Site are items belonging to the Thermoregulation, Gas Safety and Portable Instrumentation sectors (including the Be Cool range), present in the electronic catalog  published on the Site at the time the user places the order.

5.2 The availability of the Products is continuously monitored and updated. The products available for online purchase will have the "Add to Cart" icon in the product sheet. If the product is not available, it will not be possible to add it to the cart.

5.3 Each Product is accompanied by an information sheet which illustrates its main characteristics ("Product Sheet"). The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible. The colors of the Products, however, may differ from the actual ones due to the settings of the information systems or computers used by users to view them. These images must therefore be understood as indicative and with the tolerances of use. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will prevail.

Prices

6.1 All prices of the Products published on the Site are expressed in Euros and are inclusive of Value Added Tax (VAT).

6.2 Seitron S.p.A. reserves the right to change the price of the Products at any time, without notice, it being understood that the price charged to the user will be that indicated on the Site at the time the order is placed and that any variations (increase or decrease) subsequent to the transmission of the order will not be taken into account.

6.3 In the event that a Product is offered on the Site at a discounted price, the reference price against which the discount is calculated will be indicated in the Product Sheet. The discounted price will also be displayed.

Orders

7.1 The Products will remain the property of Seitron S.p.A. until the user has paid the Total Amount Due. In the event that the Total Amount Due is not paid or the successful outcome of the payment is not confirmed, the purchase contract will be considered legally terminated pursuant to and for the purposes of the art. 1456 c.c. The user will be notified via email of the termination of the contract and the consequent cancellation of the order.

7.2 Seitron S.p.A. will ship the Products only after receiving confirmation of the successful payment of the Total Amount Due by the user. The risk of loss or damage to the Products for reasons not attributable to Seitron S.p.A., however, will be transferred to the user, when the latter, or a third party designated by him and other than the carrier, physically comes into possession of the Products.

Payment methods

8.1 Payment for the Products purchased on the Site can be made through one of the solutions proposed by Axerve E-commerce Solutions: by credit card, through one of the credit cards accepted by Seitron S.p.A., as specifically indicated in the footer at the bottom right of each page of the Site. Payment solutions via the Visa, Mastercard, MyBank circuits are accepted.

8.2 Seitron S.p.A. uses the secure payment service of the company Axerve S.p.A, which involves the use of the SSL protocol. The confidential data of the credit card (card number, start date, expiry date, security code) are encrypted and transmitted directly to the payment manager without passing through the Seitron S.p.A. servers. It follows that Seitron S.p.A. will never have access to such data, nor will it ever be able to store them.

8.3 In the case of online payment by credit card, Seitron S.p.A. when the order is sent, the Total Order Amount will be debited, after having verified the validity of the card and the absence of any blocks.

8.4 In any case, if requested, the commercial invoice will be issued at the time of shipment and will be sent by e-mail to the user, to the address he has registered.

Delivery times and methods

9.1 Once confirmation of acceptance of the order has been sent, the buyer will be notified, by email, of the delivery method of their Product. The order is processed within 3-5 days from the date the order is placed. If for any reason Seitron is unable to respect the delivery terms, the user will be informed and given the options of proceeding with the order by setting a new delivery date or canceling the order, with the consequent refund of the entire amount paid.

9.2 Delivery of the Products purchased on the Site is carried out only in Italy, to the shipping address indicated by the user in the order form. Delivery is not carried out in the following locations: Campione d'Italia, Livigno, Republic of San Marino and Vatican City.

9.3 The expected delivery method is the "standard" one. This is free, unless expressly indicated in the product sheet or in other parts where shipping costs are communicated. Deliveries in "standard shipping" mode will be made via UPS; in any case, they will take place from Monday to Friday during normal office hours, excluding national holidays. In this case the change will be indicated in the Product Sheet or in another dedicated communication.

9.4 The carrier will notify the user that it has taken charge of the delivery of the package, providing more details about the delivery. Furthermore, the carrier will provide the customer with instructions to follow to possibly change the delivery date or address or may request to collect the package at a UPS Access Point.

9.5  Product receipts.  It is up to the user to check the condition of the Product delivered to him. Without prejudice to the fact that the risk of loss or damage to the Products, for reasons not attributable to Seitron S.p.A., is transferred to the user when the user, or a third party designated by the same and other than the carrier, physically comes into possession of the Products, the user is recommended to check the integrity of the packaging and the number of Products received and is invited, where possible, to indicate any anomalies on the carrier's transport document. In the event that the package shows obvious signs of tampering or alteration or damage, the user is recommended to promptly notify the carrier. For other problems relating to the product or delivery, the user must contact Seitron's Customer Service .

9.6  Failure to deliver.  The user acknowledges that the collection of the Product is his specific obligation deriving from the purchase contract. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the courier will inform him of the options available to organize delivery. If delivery is not possible after the third attempt, the package will be sent back to Seitron SpA. The customer will be contacted by Seitron in order to agree on processing the order. In case of failure to respond by the user, after 10 working days from the first delivery attempt, the contract will be considered terminated and the purchase order consequently canceled pursuant to art. 1456 c.c. Seitron S.p.A. will then proceed, within 10 working days following the termination of the contract, to refund the Total Amount Due paid by the user, less the costs of unsuccessful delivery of the Product, the costs of returning it to Seitron S.p.A and any other possible costs incurred due to the failed delivery caused by the absence of the recipient. The termination of the contract and the refund amount will be communicated to the user via email. The customer will be refunded through the same payment method used when placing the purchase order.

Warranty and liability

10.1  Conditions and Duration of the warranty.  The products sold through the e-commerce channel are assisted by the mandatory legal guarantee provided by law in favor of consumers, to cover any defects of conformity existing at the time of delivery of the goods. The legal guarantee covers any defects in conformity of the goods that may appear within two years of delivery, provided that they are reported within two months of discovering the lack of conformity. Pursuant to applicable legislation, a lack of conformity exists if the Product purchased by the customer:

  • does not conform to the description provided and does not possess the qualities presented on this website;
  • it is not suitable for the use for which the products are intended
  • normally intended;
  • does not present the qualities and characteristics of a product of the same type and which can reasonably be expected, taking into account the nature of the good and, if applicable, the specific characteristics presented.

In the event of a lack of conformity, the customer has the right to have the goods restored to conformity, at no cost to him.

If the customer believes that one or more products purchased present defects of conformity, he is invited to contact us via our Customer Support service, accessible from the website.

The following are excluded from the warranty: accidental breakages, due to natural events, due to transport, due to incorrect use or use that does not comply with what is indicated in the Product instruction sheet. Any mistreatment, repair or modification to the product not expressly authorized by Seitron will invalidate the warranty.

10.2 Nothing in these general conditions of sale will limit or exclude the liability of Seitron S.p.A. and towards buyers for:

  • for death or personal injury resulting from the negligence of Seitron S.p.A.;
  • due to willful misconduct or gross negligence of Seitron S.p.A.;
  • for violation of any provision of the Consumer Code (Legislative Decree No. 206/2005) and of any consumer protection provision whose application cannot be limited or excluded by law;
  • under any local consumer legislation applicable to the buyer which, by law, cannot be limited or excluded; or
  • for any other liability that cannot be limited or excluded by law.

Without prejudice to the above, the liability of Seitron S.p.A. on the Products delivered is provided exclusively within the limits of the amount paid by the buyers for the purchase of the Products or within the various limits expressly established by law as mandatory. As regards any damage caused by product defects, the provisions of the European Directive 85/374/EEC and the Consumer Code (Legislative Decree No. 206/2005) apply, among other things.

Right of withdrawal

11.1 The user who acts as a consumer has the right to withdraw from the Product purchase contract within 14 calendar days ("Withdrawal Period"). Beyond this period, the consumer will no longer be able to exercise the withdrawal request. The Withdrawal Period must be calculated as follows:

  • in the case of an order relating to a single Product, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Products;
  • in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product.

11.2 To exercise the right of withdrawal, the user must inform Seitron S.p.A. , before the expiry of the Withdrawal Period, of your decision to withdraw.  To this end, the user must contact our Customer Service service, indicating their desire to withdraw and providing the information relating to the order (order number and date).

11.3  Return Management . The customer who uses the right to withdraw must follow the instructions provided by Customer Service regarding the procedure to follow. After having verified the consumer's right to withdrawal, he will receive detailed instructions on the return of the Product(s), by delivery to the courier who will be sent by Seitron to the address indicated. If the customer uses this method, no costs will be charged. Seitron avails itself of the right to charge the transport costs to the customer in the event of an error in the contents of the return package, or if the customer decides to return the Product using different methods or with the "cash on delivery" method.

11.4 After having assessed the condition of the item, Seitron will inform the customer of the right to a refund of the amount paid. The refund will be made as soon as possible and in any case within 14 days from the date on which you informed us of your intention to withdraw from the Contract. Without prejudice to the foregoing, the refund may be suspended until receipt of the goods or until you demonstrate that you have sent the goods back, whichever is earlier. The refund will always be made via the payment method used to make the purchase. The risks and any costs, described above, of returning the products remain the responsibility of the customer.

Applicable Law and Jurisdiction

12.1 The purchase contract concluded on the Site is governed by Italian law. For any dispute relating to the application, execution and interpretation of these General Conditions of Sale, the court of the place where the user resides or has elected domicile is competent.

12.2 Pursuant to art. 141-sexies, paragraph 3 of Legislative Decree 6 September 2005, n. 206 (Consumer Code), Seitron S.p.A. informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter. a) of the Consumer Code, that, in the event that he has submitted a complaint directly to Seitron S.p.A., following which however it has not been possible to resolve the dispute thus arising, Seitron S.p.A. will provide information regarding the Alternative Dispute Resolution body or bodies for the extrajudicial resolution of disputes relating to obligations deriving from a contract concluded on the basis of these General Conditions of Sale (so-called ADR bodies, as indicated in articles 141-bis et seq. of the Consumer Code), specifying whether or not it intends to make use of such bodies to resolve the dispute itself. Seitron S.p.A. also informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter. a) of the Consumer Code that a European platform for the online resolution of consumer disputes has been established (so-called ODR platform). The ODR platform can be consulted at the following address  http://ec.europa.eu/consumers/odr/ ; through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the website of each of them and start an online resolution procedure for the dispute in which he is involved. In any case, the right of the consumer user to appeal to the competent ordinary judge of the dispute arising from these General Conditions of Sale, regardless of the outcome of the out-of-court settlement procedure, as well as the possibility, where the conditions are met, to promote an out-of-court resolution of disputes relating to consumer relations by resorting to the procedures referred to in Part V, Title II-bis of the Consumer Code, are without prejudice.

12.3 For any cross-border dispute relating to the application, execution and interpretation of these General Conditions of Sale, the user, who habitually resides or has domicile in a member state of the European Union other than Italy, can introduce the European procedure established for small claims by Regulation (EC) no. 861/2007 of the Council, of 11 July 2007, before the competent court, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 5,000.00 on the date on which the competent court receives the application form. Use of the site

13.1  Intellectual property . The elements published on the Seitron S.p.A website, including, in particular, the logo, registered trademarks, texts, photographs, images, drawings, models or tables, constitute works protected by intellectual property rights or personal rights. The total or partial reproduction or representation of this site is therefore prohibited without the prior and express agreement of the owners of such rights and may constitute an act of infringement sanctioned by the provisions of the Intellectual Property Code and/or a criminal act such as to imply the civil liability of the infringers of the aforementioned rights.

13.2  User responsibilities . The responsibility for browsing the Site lies entirely with the user. Seitron S.p.A. cannot be held responsible for failures, errors or computer viruses that could hinder continuity of access to the Site or malfunctions that may be encountered in the users' PC following access to the Site. Consequently, Seitron S.p.A. will not be required to compensate for direct or indirect damages that may be linked to the use of, access to the Site and/or downloading of elements contained in the Site (images, texts, video files).

13.3 The execution of the contract will be fulfilled in compliance with the obligations deriving from EU Regulation 2016/679 (GDPR). The data controller is Seitron S.p.A. a Socio Unico with headquarters in via del Commercio, 9/11 - 36065 Mussolente (VI).
